Terms of Service

1. Acceptance & changes

These Terms of Service ("Terms") govern your use of the Kamee Fitness mobile application and the website at kamee.fitness (together, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms.

We may update these Terms from time to time. When we make material changes, we'll notify you in the app and update the "Last updated" date above. Your continued use of the Service after a change takes effect means you accept the updated Terms.

2. Eligibility

You must be at least 16 years old to create an account or use the Service. By using the Service you confirm that you meet this age requirement.

You may only create an account for yourself. Don't create accounts for other people or impersonate anyone.

3. Your account & security

You're responsible for keeping your sign-in credentials safe and for all activity that happens under your account. If you suspect your account has been compromised, email us at bayogjayr@gmail.com right away.

We use Apple Sign-In, Google Sign-In, and email one-time codes for authentication. We don't store passwords ourselves.

4. The Service

Kamee Fitness helps you plan and track workouts, walks, and runs. Depending on which features you use, the Service may:

  • Generate AI-assisted workout plans (the on-device "Kamy" assistant)
  • Record sets, reps, distance, pace, and other workout data
  • Show exercise demonstration videos through YouTube's embedded player
  • Read your heart rate from Apple Health or a connected Bluetooth heart-rate strap
  • Track your location during outdoor walk or run sessions you start
  • Let you share your live location with friends ("buddies") you add, during sessions you both opt into
  • Manage Premium subscriptions through the Apple App Store or Google Play

We may add, change, or remove features over time. Some features require a Premium subscription.

5. Health & fitness disclaimer

Kamee Fitness is not a medical service and does not provide medical advice. The content, plans, heart-rate readings, and recommendations in the Service are for general fitness and informational purposes only. They are not a substitute for professional medical advice, diagnosis, or treatment.

Consult a qualified healthcare professional before starting any exercise program, changing your routine, or acting on any information you receive through the Service — especially if you have a pre-existing condition, are pregnant, or are recovering from injury.

Stop exercising and seek medical attention if you experience pain, dizziness, shortness of breath, chest discomfort, or any other symptom that concerns you.

You use the Service at your own risk.

6. Acceptable use

When you use the Service, you agree NOT to:

  • Harass, threaten, or harm other users through buddy features or shared content
  • Scrape, copy, or harvest data from the Service except through interfaces we provide
  • Reverse engineer, decompile, or attempt to extract source code or AI model weights
  • Use the Service to train, evaluate, or develop competing products
  • Sell, sublicense, or otherwise commercially exploit access to the Service or its content
  • Use the Service to coach or train third parties commercially without our written permission
  • Upload content you don't have the right to share, or content that infringes anyone's rights
  • Bypass usage limits, ads, paywalls, or any technical restriction

We may suspend or terminate your account if you break these rules.

7. Buddy features

The Service includes optional features that let you share workout activity and live location with people you've added as buddies:

  • Buddy live tracking is opt-in per session. Your location is only broadcast to buddies during a session you started and explicitly chose to share. You can stop sharing at any time by ending the session.
  • You control your buddy list. You decide who to add, who to accept, and who to remove.
  • We don't moderate what your buddies see beyond what's documented. If you share live location, your buddies will see your live location. Use buddy features only with people you trust.

8. Subscriptions, billing, and refunds

Premium features are sold through the Apple App Store (iOS) or Google Play (Android). When you subscribe:

  • The store collects payment and processes the transaction — we don't see your payment details.
  • Subscriptions auto-renew at the price and interval shown at purchase, unless cancelled at least 24 hours before the period ends.
  • You manage and cancel subscriptions in your App Store / Google Play account settings — not in the Kamee app.
  • If a free trial is offered, it converts to a paid subscription unless you cancel before it ends.

Refund requests must be submitted to Apple or Google directly per their refund policies. We're unable to process refunds for in-app purchases on their behalf. Apple: reportaproblem.apple.com. Google: play.google.com/store/account/subscriptions.

9. Your content

You own the workout data, notes, and any other content you create or upload through the Service. By using the Service, you grant Kamee Fitness a limited, worldwide, royalty-free license to store, copy, transmit, and display your content solely to provide and improve the Service for you — for example, syncing your workouts across your devices and showing your data back to you in the app.

We don't claim ownership of your content. You can delete your account (and your content) at any time from the in-app Settings.

10. Intellectual property

The Service — including the Kamee Fitness name, the Kamy mascot, the app code, the website, designs, and all related content we create — is owned by the operator of Kamee Fitness and protected by intellectual property laws. We grant you a personal, revocable, non-transferable, non-exclusive license to use the Service for its intended purpose. No other rights are granted.

11. Third-party services

The Service integrates with third-party services. Your use of those parts is also subject to those providers' terms:

  • Apple Health, Apple Sign-In, Apple Push Notifications, the Apple App Store — Apple Inc.
  • Google Sign-In, Firebase Cloud Messaging, Google Play — Google LLC
  • Supabase — backend database, authentication, realtime, and file storage
  • RevenueCat — subscription receipt validation
  • AdMob — advertising on the free tier (not used for Premium subscribers)
  • YouTube — embedded player used to show exercise demonstration videos (Google LLC)

By using the exercise-video features, you also agree to be bound by the YouTube Terms of Service (youtube.com/t/terms).

We aren't responsible for these third-party services' availability, accuracy, or actions.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT HEART-RATE, LOCATION, OR OTHER METRICS WILL BE ACCURATE. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

13. Limitation of liability

To the maximum extent permitted by Philippine law, our total liability to you for any claim arising from or relating to the Service is limited to the greater of (a) the amount you paid to Kamee Fitness in the twelve (12) months before the claim arose, or (b) PHP 5,000.

We are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost data, or personal injury, even if we have been advised of the possibility of such damages.

Nothing in these Terms limits liability that cannot be limited by law.

14. Indemnification

You agree to indemnify and hold harmless Kamee Fitness, its operator, and its third-party service providers from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from (a) your misuse of the Service, (b) your content, or (c) your violation of these Terms.

15. Termination

You may delete your account at any time from the in-app Settings, which terminates your right to use the Service.

We may suspend or terminate your account if you violate these Terms or use the Service in a way that harms us or other users. We'll give you reasonable notice when we can; for serious or ongoing violations we may act immediately.

Sections that should survive termination by their nature (intellectual property, disclaimers, limitation of liability, indemnification, governing law) survive.

16. Governing law & dispute resolution

These Terms are governed by the laws of the Republic of the Philippines, without regard to conflict-of-laws principles.

Before filing any formal claim, please email us at bayogjayr@gmail.com and give us 30 days to try to resolve the issue informally.

If informal resolution fails, you and Kamee Fitness agree to the exclusive jurisdiction of the competent courts of the Philippines for any dispute arising from these Terms or the Service.

There is no mandatory arbitration.

17. Miscellaneous

  • Severability. If any provision of these Terms is held unenforceable, the rest remains in effect.
  • Entire agreement. These Terms (together with the Privacy Policy) are the entire agreement between you and Kamee Fitness regarding the Service.
  • No waiver. Our failure to enforce a right isn't a waiver of that right.
  • Assignment. You may not assign these Terms. We may assign them in connection with a merger, acquisition, or sale of assets.
